SMS Terms and Conditions

Please read these terms and conditions carefully. The Charles and Lynn Schusterman Family Foundation and its affiliated entities in the Schusterman Philanthropic Network (collectively referred to as “CLSFF”) may provide you with an opportunity to participate in a text messaging program, including a program sending reminders on your wireless telephone.  By checking the box to sign up for one or more of the text messaging programs, you expressly consent to receive non-marketing and marketing text messages from CLSFF and others texting on its behalf, including Short Message Service (SMS) messages made with an autodialer, at the telephone number which you provide.

You represent that you are the account holder for the mobile telephone number(s) that you provide or, if under age 18, you have asked the bill payer’s permission before joining.  You are responsible for notifying CLSFF immediately if you change your mobile telephone number. You may notify CLSFF of a number change on your profile or by emailing [email protected].

By opting in, you also accept and agree to be bound by CLSFF’s privacy policy ("Privacy Policy"), the Website Terms of Use, and any other applicable terms related to your use of CLSFF’s services, and you consent to the processing of your information as set forth in those policies. We strongly urge you to review the Terms of Use and Privacy Policy in its entirety. You also agree to be bound by the following terms and conditions:

Message Frequency

Message frequency may vary. The number of text messages that you receive may differ depending on the messaging program in which you have enrolled.

Costs

Standard carrier message and data rates may apply. By providing your consent to participate in the program, you approve any such charges from your mobile carrier. Please consult your mobile service carrier's pricing plan to determine the charges for sending and receiving text messages.

Participating Carriers

This text messaging program may not be available on all wireless carriers. The program is currently available for AT&T, Verizon Wireless, Sprint, MetroPCS®, and T-Mobile®. T-Mobile is not liable for delayed or undelivered messages. CLSFF may add or remove any wireless carrier from this program without notice.

Opt-Out

You can opt out from future messages at any time by texting STOP to 46772 from your mobile phone. You agree that if you request to opt out from future messages, we may send you a one-time opt-out confirmation text message. 

Eligibility

To receive text messages, you must be age 14 years or older and obtain parental consent. You must also obtain consent from the owner of the device, who may also be your parent or guardian, before opting-in to receive text messages. CLSFF reserves the right to require you to prove that you are at least 14 years of age and have obtained parental consent, as well as consent from the device owner to receive text messages.

Modification or Termination

CLSFF reserves the right to modify or terminate the SMS service, in whole or in part, at any time with or without notice.  CLSFF may suspect or terminate your receipt of text messages if CLSFF believes that you are in breach of these SMS Terms and Conditions.

Automatic Dialing System

The U.S. Federal Communications Commission defines an "automatic telephone dialing system" or autodialer as equipment that has the capacity to store or produce telephone numbers to be called and to call such numbers. 47 C.F.R. § 64.1200. By your subscription to a text message program, you give your express consent to CLSFF to use an automatic dialing system to deliver text messages to the telephone or cell phone number to which you have directed CLSFF to transmit these text messages. Please note that consent to receive text messages is not required to apply to or participate in any CLSFF programs.

You agree to indemnify CLSFF in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify CLSFF if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act. 

Changes to Terms and Conditions

CLSFF may revise, modify or amend these SMS Terms and Conditions at any time. Any such revision, modification or amendment shall take effect when it is posted to the CLSFF website. You agree to review these SMS Terms and Conditions periodically to ensure that you are aware of any changes. You continued consent to receive CLSFF text messages will indicate your acceptance of those changes.
